Terms and Conditions for the Australian Waterski and Wakeboard Federation (AWWF)
- Definitions
In these terms and conditions:
• “AWWF” refers to the Australian Waterski and Wakeboard Federation Incorporated.
• “Claim” refers to any action, suit, demand, or expense arising, including but not limited to negligence, excluding any rights expressly conferred by the AWWF’s constitution or regulations.
• “Discipline” refers to any type of water skiing recognised and governed by the AWWF.
• “Division” refers to a committee under the AWWF controlling a specific Discipline.
• “Member State” refers to an entity recognised by the AWWF to administer water skiing within a particular state.
• “Water Ski Activities” refers to participation in any authorised or recognised Water Ski Organisation activity.
• “Water Ski Organisation” refers to the AWWF, Member States, Divisions, and any associated directors, officers, members, servants, or agents. - Membership
By applying for membership with the AWWF, Member State, and Division, your membership will be deemed accepted once you participate in any Water Ski Activities. You agree to comply with the constitutions, regulations, and policies of the Water Ski Organisations to which you belong. - Acknowledgement of Risks
You acknowledge that Water Ski Activities are inherently dangerous and come with risks, including but not limited to:
• Physical or mental injury, impairment, or death.
• Actions of other participants.
• Unpredictable conditions or environments.
• Pressure-based decisions by organisers, officials, and representatives.
• The possible avoidance of insurance policies related to health or life.
• Inadequate treatment or transport facilities in case of injury.
• Damage, loss, or destruction of property.
You voluntarily accept these risks by participating in Water Ski Activities. - Exclusion of Implied Terms
If you are a consumer of recreational services, you acknowledge that implied terms and rights, along with any liability from the Water Ski Organisations, are excluded to the extent possible by law. The liability of the Water Ski Organisations is limited to the resupply of services or the cost of having the services supplied again. - Release and Indemnity
By applying for membership, you:
• Release the Water Ski Organisations from any Claims related to your participation in Water Ski Activities.
• Indemnify the Water Ski Organisations against any Claims made by any person arising from your membership or participation. - Fitness to Participate
You declare that you are physically and medically fit to engage in Water Ski Activities. You must notify the AWWF of any changes to your fitness or medical condition. Your fitness declaration remains valid for the duration of your participation. - Medical Treatment
You consent to receiving necessary or desirable medical treatment during Water Ski Activities. You agree to reimburse any costs incurred by the Water Ski Organisation in providing treatment. - Right to Use Image
You consent to the AWWF capturing and using photographs and electronic images taken during your participation for promotional purposes, without further consent. You agree to the use of your name, image, likeness, and performance to promote Water Ski Activities. - Privacy
Your personal information is required for the operations of the Water Ski Organisations. This information will be shared between the AWWF, Member States, and Divisions for organisational purposes. You may access your information through your Member State. If your personal information is not provided, your membership application may be rejected. The Water Ski Organisations may also send you promotional material, which you can opt-out of by contacting your Member State. - Severance
If any provision of these terms is invalid or unenforceable in a particular jurisdiction, it will be read down or severed to the extent of the invalidity, without affecting the remaining provisions or the enforceability in other jurisdictions. - Anti-Doping Compliance
You agree to comply with the IWWF Anti-Doping Rules, as well as any additional rules adopted by your National Federation. - Accurate Information
You confirm that all information provided in your membership application is accurate and correct. Amendments to these terms and conditions will render your application null and void. - Waterway Regulations
You acknowledge that specific rules may apply to waterways and waterskiing activities in each state or territory and agree to comply with them at all times. - Insurance Coverage
You acknowledge that the AWWF holds public liability insurance up to $20,000,000 for any one occurrence.
By agreeing, you confirm you have read, understood, and accepted these terms and conditions.
For applicants under 18 years of age:
The parent or legal guardian must authorise the applicant’s participation and agree to be responsible for the applicant’s behaviour and compliance with the terms outlined above.
